Do Not Sell or Share My Personal Information - Eduplore

Official legal, privacy, compliance, and regulatory documentation for Eduplore (eduplore.in) and the Eduplore mobile application on Google Play Store.

Introduction

This page explains the rights of users of Eduplore, including students, parents and guardians, teachers, school administrators, and other visitors to eduplore.in and the Eduplore mobile application available on Google Play Store (https://play.google.com/store/apps/details?id=com.eduplore.app), to opt out of the sale or sharing of their personal information. Eduplore is an Indian learning management system and learning application for students in Class 8, Class 9, and Class 10 in Karnataka, offering video courses, interactive three-dimensional STEM laboratories, quizzes and assessments, progress analytics, and related learning features in Kannada and English.

Eduplore respects the privacy choices of its users. This page is provided to meet the requirements of the California Consumer Privacy Act as amended by the California Privacy Rights Act, together referred to in this page as CCPA as amended by CPRA, and to explain related choices available under the Digital Personal Data Protection Act 2023 of India, referred to in this page as the DPDP Act 2023, the Information Technology Act 2000 of India, and the Consumer Protection Act 2019 of India. This page should be read together with the Eduplore Privacy Policy, Terms of Use, Cookie Policy, and any school agreement or institutional agreement that applies to a school account.

This page uses plain language where possible. Where a legal term is used, this page defines it in context. If there is a conflict between a summary in this page and the full text of an applicable law, the law prevails. If there is a conflict between this page and a school agreement that provides stronger protection for a student, the stronger protection applies for that student.

This page applies to personal information collected through the Eduplore website, the Eduplore mobile application, Eduplore video courses, Eduplore three-dimensional laboratories, Eduplore quizzes and assessments, Eduplore progress analytics dashboards, Eduplore account registration and login, Eduplore customer support, Eduplore in-app purchases and subscriptions, Eduplore communications, and any other Eduplore service that links to this page. It also applies to information collected offline where that information is later used in connection with an Eduplore account, for example information provided on a school enrolment form that is entered into the Eduplore system.

1. Purpose of this page

1.1. The purpose of this page is to give every Eduplore user a clear, practical way to tell Eduplore not to sell or share their personal information.

1.2. The purpose of this page is also to explain, in one place, which categories of personal information Eduplore collects, which categories may be disclosed to third parties, for what purposes, and how a user can exercise the right to opt out.

1.3. This page is intended to help users in California exercise rights under CCPA as amended by CPRA, and to help users in India exercise rights to withdraw consent and to opt out of certain processing under the DPDP Act 2023.

1.4. This page is intended to be used by students, parents and guardians acting for a student, teachers acting within their school role, school administrators acting for a school, and any other user who wishes to limit the sale or sharing of their personal information.

1.5. This page does not cover every privacy right. Other rights, including the right to know what personal information has been collected, the right to delete personal information, the right to correct inaccurate personal information, the right to limit the use of sensitive personal information, and the right to access and to seek correction and erasure under Indian law, are described in the Eduplore Privacy Policy. A user may exercise those rights through the methods described in the Privacy Policy and in this page.

1.6. Eduplore will not require a user to create a new account, to pay a fee, or to provide unnecessary personal information in order to submit an opt-out request. An opt-out request can be submitted by the methods listed in Section 8 of this page.

1.7. Eduplore will honour a valid opt-out request as described in this page, subject to verification and to the exceptions permitted by law. Eduplore will not discriminate against a user for exercising the right to opt out, as explained in Section 12.

2. Definitions used in this page

2.1. Personal information means information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or household. Under California law this is a broad definition. Under Indian law, the DPDP Act 2023 uses the term personal data for data about an individual who is identifiable by or in relation to such data. In this page, personal information and personal data are used to refer to the same practical concept unless the context requires a distinction, and the rights described apply under the relevant law for the relevant user.

2.2. Sale means selling, renting, releasing, disclosing, disseminating, making available, transferring, or otherwise communicating orally, in writing, or by electronic or other means, a consumer's personal information by a business to a third party for monetary or other valuable consideration. Under CCPA as amended by CPRA, a disclosure can be a sale even when the consideration is not money, for example when personal information is shared in exchange for advertising services or analytics services that benefit Eduplore.

2.3. Sharing means sharing, renting, releasing, disclosing, disseminating, making available, transferring, or otherwise communicating orally, in writing, or by electronic or other means, a consumer's personal information by a business to a third party for cross-context behavioural advertising, whether or not for monetary or other valuable consideration, including transactions between a business and a third party for cross-context behavioural advertising for the benefit of the business in which no money is exchanged.

2.4. Service provider and contractor mean a person or organisation that processes personal information on behalf of Eduplore under a written contract that limits the use of that information to the purposes stated in the contract, and that requires the service provider or contractor to protect the information and to comply with applicable law.

2.5. Data Principal, under the DPDP Act 2023, means the individual to whom the personal data relates. In the Eduplore context, the Data Principal is normally the student, and where the student is a child, the parent or lawful guardian acts on behalf of the child as described in the DPDP Act and in this page.

2.6. Consent, under the DPDP Act 2023, means consent that is free, specific, informed, unconditional, and unambiguous, given by a clear affirmative action signifying agreement to the processing of personal data for a specified purpose, and limited to such personal data as is necessary for such specified purpose.

2.7. Child, under the DPDP Act 2023, means an individual who has not completed the age of 18 years. Under California law, a minor is a person under the age of 18, and a child under the age of 13 is subject to additional protections. In this page, child and minor are used to refer to a person under the age of 18 unless the context states a different age threshold.

2.8. Authorised agent means a person authorised by a consumer to act on the consumer's behalf to submit an opt-out request, as described in Section 10 of this page.

2.9. Opt-out request means a request by a consumer, or by a person acting on behalf of a consumer, to direct Eduplore not to sell or share the consumer's personal information.

2.10. Eduplore services means the Eduplore website at eduplore.in, the Eduplore mobile application, video courses, three-dimensional laboratories, quizzes, assessments, progress analytics, account services, customer support, and any other service that links to this page.

3. Who this page applies to

3.1. This page applies to every person who uses Eduplore services, including a student enrolled in Class 8, Class 9, or Class 10, a student in another class who uses Eduplore, a parent or guardian of a student, a teacher, a school administrator, a school owner or manager, and a visitor to eduplore.in.

3.2. This page applies to students who use Eduplore through a school account, through a personal account created by a parent or guardian, and through a trial or demo account. The method of account creation does not reduce the rights described in this page.

3.3. This page applies to users in California who have rights under CCPA as amended by CPRA. It also applies to users in India who have rights under the DPDP Act 2023, the Information Technology Act 2000, and the Consumer Protection Act 2019. Users in other places may also submit an opt-out request under this page, and Eduplore will honour the request where it is practicable to do so.

3.4. This page applies to personal information collected from a user directly, for example when a user registers an account, completes a profile, enrols in a video course, uses a three-dimensional laboratory, attempts a quiz, views progress analytics, contacts support, or makes an in-app purchase or subscription. It also applies to personal information collected automatically, for example device information, usage information, and advertising identifiers, where applicable.

3.5. This page applies to personal information collected from a school about a student, for example a name, class, section, roll number, school name, and enrolment status, when that information is provided to Eduplore by a school for the purpose of creating or managing a student account.

3.6. This page applies to personal information collected from a parent or guardian about a child, for example a parent name, phone number, email address, and consent record, when that information is provided to Eduplore for the purpose of creating or managing a child account or for communication about the child learning progress.

3.7. Where a school has entered into an agreement with Eduplore that restricts the sale or sharing of student personal information, that agreement applies in addition to this page. If a school agreement prohibits a disclosure that this page would otherwise permit, the school agreement prevails for students covered by that agreement.

4. Categories of personal information Eduplore collects

4.1. Eduplore collects personal information that is needed to provide the learning service, to manage accounts, to support students and teachers, to improve the service, and to comply with legal obligations. The categories below describe the types of information that may be collected. Not every category is collected from every user, and the categories collected depend on how the user uses Eduplore, whether the user is a student, parent, teacher, or school administrator, and whether the user has given consent where consent is required.

4.2. Identifiers. This category includes a name, alias, postal address, unique personal identifier, online identifier, Internet Protocol address, email address, account name, phone number, and other similar identifiers. For a student, this may include the student name as provided by the parent, guardian, or school, and a student account username. For a parent or teacher, this may include a name, email address, and phone number provided during registration or support contact.

4.3. Personal information described in California Civil Code Section 1798.80(e). This category includes a name, signature, address, telephone number, education information, employment information where relevant to a teacher or school staff member, and other information that is capable of being associated with an individual. Education information includes class, section, school name, enrolment status, and course enrolment records.

4.4. Commercial information. This category includes records of products or services purchased, obtained, or considered, and other purchasing or consuming histories or tendencies. For Eduplore, this includes records of video courses enrolled in, three-dimensional laboratory modules accessed, in-app purchases made, subscriptions started or renewed or cancelled, and related transaction records. Payment card details are processed by a payment service provider and are not stored by Eduplore in full form.

4.5. Internet or other electronic network activity information. This category includes browsing history, search history, and information regarding interaction with the Eduplore website, the Eduplore application, video courses, three-dimensional laboratories, quizzes, and advertisements, where applicable. It includes pages viewed, videos watched, time spent on a lesson, laboratory interactions, quiz attempts, and clicks within the application.

4.6. Geolocation data. Eduplore does not require precise geolocation for the ordinary use of the learning service. Where a device provides approximate location information, for example a general region derived from an Internet Protocol address, that information may be used for service delivery, security, and compliance with regional requirements. Precise geolocation is not collected for advertising without consent where consent is required.

4.7. Education information that is not publicly available. This category includes a student name, class, school, grades, quiz scores, assessment results, progress analytics, attendance in a course, and other records directly related to a student learning activity. Eduplore treats education information as personal information and protects it under the rules in this page and in the Privacy Policy.

4.8. Inferences drawn from other personal information. This category includes inferences drawn from information listed above to create a profile about a person reflecting the person preferences, characteristics, psychological trends, predispositions, behaviour, attitudes, intelligence, abilities, and aptitudes. For Eduplore, inferences may include learning progress summaries, recommended lessons based on quiz performance, and progress analytics that help a student, parent, or teacher understand learning strengths and areas for improvement. Inferences used for learning recommendations inside Eduplore are not a sale or sharing for advertising, but inferences shared with a third party for advertising would be covered by the opt-out right.

4.9. Eduplore updates this list when it adds a new feature that collects a new category of personal information. Any change will be described in an updated Privacy Policy and, where the change affects sale or sharing, in an updated version of this page.

5. What sale and sharing mean, and what Eduplore does

5.1. Under California law, sale and sharing are defined broadly. A disclosure of personal information to a third party can be a sale or sharing even if Eduplore does not receive money, and even if the disclosure is made for a service that benefits Eduplore, such as advertising, analytics, or audience measurement.

5.2. The following are examples of disclosures that can be a sale or sharing under California law, if they occur. The list is illustrative, not exhaustive, and whether a particular disclosure is a sale or sharing depends on the contract with the third party, the purpose of the disclosure, and the law in force at the time.

5.3. Disclosure to an advertising network or advertising partner of an advertising identifier, device identifier, or browsing activity for the purpose of showing an advertisement to the user on another website or application, or for the purpose of measuring whether an advertisement was viewed or clicked.

5.4. Disclosure to an analytics provider of usage information that is then used by that provider to build a profile of the user for advertising on other services, where the provider is not acting solely as a service provider under a contract that limits its use of the information.

5.5. Disclosure to a data broker or similar third party of identifiers or commercial information for the purpose of building or enriching a profile that is used for advertising.

5.6. The following disclosures are not a sale or sharing under California law when they are made under the conditions described in the law, and Eduplore will continue to make these disclosures even after a user opts out, because they are needed to provide the service or to comply with law.

5.7. Disclosure to a service provider or contractor that processes personal information on behalf of Eduplore under a written contract that limits the use of the information to the purposes stated in the contract, for example a cloud hosting provider that stores video course content, a payment processor that processes a subscription payment, a customer support provider that handles a support request, or an analytics provider that provides aggregate usage reports to Eduplore only and does not use the information for its own advertising purposes.

5.8. Disclosure to a school, parent, or guardian of a student own learning information, for example a progress report, quiz score, or attendance record, where the disclosure is made to the person who is entitled to receive that information for educational purposes.

5.9. Disclosure to a teacher of information about students in that teacher class, for example quiz results and progress analytics for students assigned to that teacher, where the disclosure is needed for teaching and learning management.

5.10. Disclosure to comply with a legal obligation, to protect the safety of a user or another person, to prevent fraud or abuse, or to cooperate with law enforcement where required by law and after appropriate review.

5.11. Eduplore current practice is to limit disclosures for advertising. Eduplore does not sell personal information for money. Eduplore does not sell the personal information of students for advertising. Eduplore does not sell lists of student names, email addresses, phone numbers, or school details to data brokers. If Eduplore uses advertising partners or software development kits that collect advertising identifiers, the details are described in the AdChoices page and in the Privacy Policy, and a user can opt out as described in this page.

6. The right to opt out of sale and sharing under California law

6.1. A California consumer has the right to direct a business that sells or shares the consumer personal information to not sell or share that information. This is known as the right to opt out of sale and sharing.

6.2. The right to opt out applies to the sale and sharing of personal information as defined in Section 2 and Section 5 of this page. It applies to future sales and sharing after the request is processed, and Eduplore will apply the opt-out promptly as described in Section 9.

6.3. The right to opt out does not require the consumer to provide a reason. A consumer may opt out for any reason, or for no reason, and Eduplore will not ask the consumer to justify the request.

6.4. The right to opt out is available to a California consumer who is at least 18 years old, and to a parent or guardian acting on behalf of a child as described in Section 11. Special rules apply to minors, and Eduplore will not sell or share the personal information of a consumer Eduplore knows to be under the age of 16 without the required consent.

6.5. A consumer who has opted out may later withdraw the opt-out and authorise Eduplore to sell or share personal information, by submitting a request to opt back in through the methods described in this page, subject to verification. Eduplore will not treat a general use of the service as an opt-in, and will require a clear affirmative action to opt back in.

6.6. The right to opt out does not prevent Eduplore from collecting personal information, from using personal information to provide the learning service, or from disclosing personal information to service providers and contractors as described in Section 5. The right is limited to sale and sharing as defined by law.

6.7. The right to opt out does not prevent Eduplore from using personal information for purposes that are not a sale or sharing, for example to deliver a video course, to save a student quiz result, to show a parent a progress report, to process a subscription payment, to provide customer support, or to keep the service secure.

6.8. Eduplore will honour a Global Privacy Control signal where it is technically feasible to do so, as described in Section 8. A Global Privacy Control signal is a browser or device setting that communicates a user preference to opt out of sale and sharing. Eduplore will treat a valid Global Privacy Control signal as an opt-out request for the browser or device that sends the signal, subject to verification where verification is required by law.

7. Categories of personal information sold or shared, and to whom

7.1. This section describes the categories of personal information that Eduplore may sell or share, the categories of third parties to whom that information may be sold or shared, and the purposes of the sale or sharing, as required by California law. If Eduplore does not sell or share a category, this section states that.

7.2. Identifiers, including advertising identifiers, device identifiers, Internet Protocol addresses, and online identifiers, may be shared with advertising partners and analytics providers for the purpose of showing advertisements, measuring advertising effectiveness, and understanding how users interact with Eduplore, where such sharing occurs. This sharing is subject to the opt-out right in this page.

7.3. Internet or other electronic network activity information, including pages viewed, videos watched, laboratory interactions, and clicks, may be shared with advertising partners and analytics providers for the purpose of advertising measurement and service improvement, where such sharing occurs. This sharing is subject to the opt-out right.

7.4. Commercial information, including records of courses enrolled in and subscriptions held, is not sold to advertising partners for the purpose of cross-context behavioural advertising. Commercial information may be shared with a payment processor or subscription management provider as a service provider for the purpose of processing a transaction, which is not a sale or sharing.

7.5. Education information, including quiz scores, assessment results, and progress analytics, is not sold or shared for advertising. Education information is shared only with the student, the parent or guardian of the student, the teacher assigned to the student, and the school that enrolled the student, and with service providers who process that information on behalf of Eduplore for learning purposes.

7.6. Personal information of students under the age of 18, including names, classes, schools, quiz scores, and progress records, is not sold or shared for advertising. Eduplore does not sell or share the personal information of a child for cross-context behavioural advertising.

7.7. Sensitive personal information is not sold or shared for advertising. Any disclosure of sensitive personal information is limited to the purposes described in the Privacy Policy and to compliance with legal obligations.

7.8. The categories of third parties to whom personal information may be sold or shared, where such sale or sharing occurs, include advertising networks, advertising measurement providers, analytics providers, and social media platforms that provide advertising services, where those parties are not acting solely as service providers under a contract that limits their use of the information.

7.9. The categories of third parties to whom personal information is disclosed as a service provider or contractor, which is not a sale or sharing, include cloud hosting providers, video hosting and delivery providers, payment processors, customer support providers, email and messaging providers, and analytics providers that provide reports to Eduplore only.

8. How to submit an opt-out request

8.1. A user may submit an opt-out request by any of the following methods. Eduplore will accept a request submitted by any method listed here, and will not require the user to use a particular method.

8.2. Method one, web form. Submit the Do Not Sell or Share request through the web form linked from this page and from the Privacy Policy, at the link listed as [Do Not Sell web form link - to be filled by Venkatesh]. The form will ask for the minimum information needed to identify the account and to verify the request, as described in Section 9. A user who submits the form will receive an acknowledgement where an email address is provided.

8.3. Method two, email. Send an email to [Do Not Sell request email address - to be filled by Venkatesh] with the subject line Do Not Sell or Share My Personal Information. In the email, state that you wish to opt out of the sale and sharing of your personal information, provide the name on the account, the email address or phone number associated with the account, and, if the request is for a child, the child name, class, and school, and your relationship to the child. Do not include passwords, payment card details, or other sensitive information in the email.

8.4. Method three, in-app setting. Where the Eduplore app provides a privacy setting, open the app, go to Profile or Settings, then Privacy, then Do Not Sell or Share My Personal Information, and turn on the opt-out setting. The app will confirm the change on screen. This method is available to a user who is signed in to the app. A parent or guardian who manages a child account should use the parent account to change the setting for the child account.

8.5. Method four, website account setting. Sign in to eduplore.in, go to Account Settings or Privacy Settings, and select Do Not Sell or Share My Personal Information. Confirm the choice. The website will show a confirmation message when the opt-out has been recorded.

8.6. Method five, Global Privacy Control. Enable the Global Privacy Control setting in a supported browser or device, and then visit eduplore.in. Eduplore will treat a valid Global Privacy Control signal as an opt-out request for that browser or device, where technically feasible. A user who uses more than one browser or device should enable the signal on each browser or device, or submit a separate opt-out request that covers the account, so that the opt-out applies across devices.

8.7. Method six, customer support. Contact Eduplore customer support through the contact details in Section 25, and state that you wish to opt out of the sale and sharing of personal information. Support will record the request and will ask for the information needed for verification. Support will not ask for a password.

8.8. Method seven, postal request. Send a written request to 1st Floor, SLA Inn, 7, Hootagalli, Hutagalli, Mysuru, Karnataka 570018, marked for the attention of the Grievance Officer, stating that you wish to opt out of the sale and sharing of personal information, and providing the account identification details described in Section 8.3. Postal requests will be processed in the same way as email requests, allowing additional time for delivery.

8.9. A user may submit an opt-out request on behalf of another person only as an authorised agent under Section 10, or as a parent or guardian under Section 11, or as a school administrator acting under a school agreement and with lawful authority. A teacher may not submit an opt-out request on behalf of a student unless the teacher is acting as an authorised agent or under a school instruction that authorises the teacher to do so.

8.10. Eduplore will provide a confirmation of receipt where contact details are provided, and will provide a confirmation when the opt-out has been applied, subject to verification. If Eduplore cannot verify the request, Eduplore will explain what additional information is needed, and will give the user a reasonable opportunity to provide it.

8.11. An opt-out request does not require the user to delete the account. A user who opts out can continue to use Eduplore video courses, three-dimensional laboratories, quizzes, and progress analytics in the ordinary way, subject to the non-discrimination rules in Section 12.

9. Verification of an opt-out request

9.1. Eduplore must verify that a person who submits an opt-out request is the consumer to whom the personal information relates, or is a person authorised to act on behalf of that consumer. Verification protects users from unauthorised requests that would limit the use of their information without their consent.

9.2. For an opt-out request, Eduplore will use a risk-based verification process. In most cases, verification will be limited to matching the information provided in the request with information already held in the Eduplore account, for example the account email address, phone number, account username, student name, class, and school name. Eduplore will not require a user to provide a government identity document for a routine opt-out request, unless the request raises a reasonable doubt about identity that cannot be resolved by matching account information.

9.3. If a user is signed in to the Eduplore account when submitting the request through the app or website setting, that signed-in status is itself evidence of identity, and no additional verification will normally be required for the opt-out to be applied to that account.

9.4. If a request is submitted by email or by web form without being signed in, Eduplore may send a verification message to the email address or phone number associated with the account, asking the user to confirm the request by replying to the message or by clicking a verification link. Eduplore will process the opt-out promptly after verification is complete.

9.5. If the information provided does not match the account, Eduplore will contact the requester to ask for additional information that can be matched, for example the date of account creation, the school name, the class, or a recent course enrolled in. Eduplore will not ask for a password, a full payment card number, or a one-time password that is used to sign in.

9.6. If Eduplore cannot verify the request after reasonable efforts, Eduplore will inform the requester that the request cannot be verified, explain what information was missing, and invite the requester to submit a new request with correct information. Eduplore will not apply an opt-out to an account where identity cannot be verified, because doing so could harm the account holder.

9.7. Eduplore will process a verified opt-out request promptly and in any case within the time limit required by applicable law. Under California law, a business must comply with a request to opt out as soon as practicably possible and in any case within fifteen business days from the date the request is received, where the request is verifiable. Eduplore aims to apply an opt-out within that period, and will notify the user when the opt-out has been applied.

9.8. Eduplore will maintain a record of opt-out requests, including the date of the request, the date the opt-out was applied, and the method of verification, for the period required by law and by the Eduplore retention policy. That record is kept for compliance purposes and is not used for advertising.

10. Authorised agents

10.1. A California consumer may authorise another person to act as an authorised agent to submit an opt-out request on the consumer behalf. An authorised agent may be a family member, a lawyer, a consumer organisation, or another person authorised in writing by the consumer.

10.2. To submit a request as an authorised agent, the agent must provide evidence that the consumer has authorised the agent to act on the consumer behalf. Acceptable evidence includes a written authorisation signed by the consumer that states the scope of the authorisation and the agent name, or a power of attorney that authorises the agent to act for the consumer in privacy matters.

10.3. Eduplore may also require the authorised agent to verify the agent own identity, and may contact the consumer directly to confirm the authorisation, where it is reasonable to do so. Eduplore will not unreasonably delay an authorised agent request where the authorisation is clear.

10.4. An authorised agent who submits a request for a child must also meet the requirements for a parent or guardian in Section 11, or provide evidence that the parent or guardian has authorised the agent to act for the child.

10.5. Eduplore may deny a request from a person who claims to be an authorised agent but who does not provide evidence of authorisation, or where the evidence is incomplete or appears to be forged. In that case, Eduplore will explain the reason for the denial and will invite the agent to provide the missing evidence or to ask the consumer to submit the request directly.

10.6. In India, a person who acts on behalf of a Data Principal under the DPDP Act 2023 must have lawful authority to do so. A parent or guardian acting for a child, a person holding a power of attorney, and a legal representative acting for a person who is unable to act for themselves are examples of persons with lawful authority. Eduplore will ask for evidence of that authority where it is reasonable to do so.

12. Non-discrimination

12.1. Eduplore will not discriminate against a user for exercising the right to opt out of sale or sharing. Discrimination includes denying a service, charging a different fee or rate for a service, providing a different level or quality of a service, and suggesting that a user will receive a different fee or rate or a different level or quality of service if the user exercises the right to opt out.

12.2. A user who opts out will continue to receive the same Eduplore learning service, including access to video courses, three-dimensional laboratories, quizzes, assessments, and progress analytics, on the same terms as a user who has not opted out, subject to the ordinary terms of the service and to any subscription terms that apply to all users.

12.3. Eduplore will not deny access to a video course, a three-dimensional laboratory, a quiz, or a progress report because a user has opted out. Eduplore will not reduce the quality of a video, limit the number of laboratory interactions, or withhold a certificate because a user has opted out.

12.4. A user who believes that Eduplore has discriminated against them for exercising the right to opt out should contact Eduplore support using the contact details in Section 25, and may also contact the relevant regulator as described in Section 24.

14. Indian law: Information Technology Act 2000

14.1. The Information Technology Act 2000, together with the rules made under that Act, including the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules 2011, referred to as the SPDI Rules, sets requirements for the collection, use, disclosure, and protection of sensitive personal data or information in India.

14.2. Under the SPDI Rules, sensitive personal data or information includes passwords, financial information such as bank account or payment card details, physical, physiological, and mental health condition, sexual orientation, medical records and history, and biometric information. Eduplore collects sensitive personal data only where it is needed for a lawful purpose and with consent where consent is required.

14.3. Eduplore will not disclose sensitive personal data or information to a third party without the prior permission of the provider of the information, except where the disclosure is required by law, or where the disclosure is necessary for compliance with a legal obligation. A user who wishes to withdraw permission for the disclosure of sensitive personal data may submit a request under Section 8, and Eduplore will process the request in accordance with the SPDI Rules and the DPDP Act 2023.

14.4. Eduplore maintains reasonable security practices and procedures to protect personal information, as described in Section 21. Those practices include technical and organisational measures to prevent unauthorised access, disclosure, alteration, and destruction of personal information.

15. Indian law: Consumer Protection Act 2019

15.1. The Consumer Protection Act 2019 protects consumers in India from unfair trade practices, misleading advertisements, and deficient services. Eduplore is committed to providing clear information about its services, including about how personal information is used, and to not engaging in misleading practices in relation to privacy choices.

15.2. A user who is a consumer under the Consumer Protection Act 2019 has the right to be informed about the quality, quantity, potency, purity, standard, and price of goods or services, and to be protected against unfair trade practices. In the context of privacy, this means that Eduplore will provide clear information about what personal information is collected, how it is used, whether it is sold or shared, and how a user can opt out.

15.3. Eduplore will not make a false or misleading statement about its privacy practices, about whether it sells or shares personal information, or about the effect of opting out. If a statement in this page or in the Privacy Policy is found to be inaccurate, Eduplore will correct it promptly and will inform users where required by law.

15.4. A consumer who has a complaint about Eduplore services, including about privacy practices, may contact Eduplore support using the contact details in Section 25. If the complaint is not resolved, the consumer may raise the complaint through the consumer dispute redressal mechanisms under the Consumer Protection Act 2019, including the Central Consumer Protection Authority and the consumer commissions, in accordance with the Act.

16. Learning features: video courses, three-dimensional laboratories, quizzes, and progress analytics

16.1. Eduplore video courses include recorded lessons in Kannada and English for Class 8, Class 9, and Class 10 subjects, including Science, Mathematics, Social Science, English, and Kannada where applicable. When a student watches a video course, Eduplore records that the student viewed the lesson, the progress through the lesson, and the completion status, for the purpose of showing the student their own progress and for helping the parent or teacher understand learning.

16.2. Eduplore three-dimensional laboratories include interactive modules such as the Human Body laboratory, the Heart and ECG laboratory, the Cell laboratory, the Periodic Table laboratory, the Molecular laboratory, the Chemistry laboratory, the Universe laboratory, the Solar System laboratory, the Space laboratory, the Physics laboratory, and the Vector Calculus laboratory, where those laboratories are available. When a student uses a three-dimensional laboratory, Eduplore records interactions such as the parts explored, the systems viewed, the rotation and explode settings used, and the time spent, for the purpose of showing progress and for improving the laboratory.

16.3. Eduplore quizzes and assessments include multiple-choice questions, short-answer questions, and other assessment formats linked to video courses and three-dimensional laboratories. When a student attempts a quiz, Eduplore records the questions attempted, the answers given, the score, the time taken, and the number of attempts, for the purpose of providing feedback and progress analytics.

16.4. Eduplore progress analytics includes dashboards for students, parents, and teachers that show course completion, quiz scores, laboratory usage, time spent learning, and areas for improvement. Progress analytics is generated from the learning records described in this section, and is shown only to the student, the parent or guardian of the student, the teacher assigned to the student, and the school that enrolled the student.

16.5. Learning records described in this section are not sold or shared for advertising. An opt-out request under this page does not stop Eduplore from recording learning progress for the purpose of providing the learning service, and does not delete learning records. A user who wishes to delete learning records should submit a deletion request under the Privacy Policy.

16.6. Learning records are not shared with advertising partners. Learning records are not used to target advertisements to a student on another website or application. Learning records are not used to build an advertising profile of a student.

17. Accounts, in-app purchases, and subscriptions

17.1. Eduplore accounts include student accounts, parent accounts, teacher accounts, and school administrator accounts. Each account type has different permissions, and the account holder is responsible for keeping the account credentials secure and for not sharing the password with another person.

17.2. A student account is normally created by a parent, guardian, or school. The student should use the account only for learning purposes, and should not use the account to provide personal information to a third party without the parent or guardian permission.

17.3. A parent account is linked to one or more student accounts, and allows the parent to view progress analytics, to manage consent and privacy settings for the child, and to manage subscriptions and purchases for the child.

17.4. A teacher account is linked to classes and students assigned to that teacher, and allows the teacher to view progress analytics for those students, to assign video courses and quizzes, and to manage class enrolment.

17.5. A school administrator account is linked to the school, and allows the administrator to manage teacher accounts, student accounts, class lists, and school settings, in accordance with the school agreement.

17.6. In-app purchases and subscriptions are processed through Google Play Store where the purchase is made in the Eduplore app, or through a payment service provider where the purchase is made on eduplore.in. Eduplore does not store full payment card details. Payment information is processed by the payment provider under its own privacy policy, and Eduplore receives only the information needed to confirm the purchase, to manage the subscription, and to provide customer support.

17.7. Purchase and subscription records, including the course or laboratory purchased, the subscription start and end dates, and the transaction status, are kept for accounting, tax, and customer support purposes. Those records are not sold or shared for advertising.

17.8. An opt-out request does not cancel a subscription and does not refund a purchase. A user who wishes to cancel a subscription should use the subscription management feature in Google Play Store or on eduplore.in, or contact support. A user who wishes to request a refund should follow the refund policy in the Terms of Use.

18. Third-party services and service providers

18.1. Eduplore uses third-party service providers to operate the service. Those providers process personal information on behalf of Eduplore under written contracts that limit their use of the information and require them to protect it. The categories of service providers are listed in this section.

18.2. Cloud hosting and storage providers store video course content, three-dimensional laboratory assets, account data, and learning records, and provide the infrastructure that allows Eduplore to operate reliably and securely.

18.3. Video hosting and delivery providers deliver video course content to a user device, and provide playback, buffering, and quality adjustment features. Those providers may collect device and network information needed to deliver the video.

18.4. Payment processors and subscription management providers process in-app purchases and subscriptions, verify payment, manage recurring billing, and handle refunds where applicable, under their own security and privacy standards.

18.5. Customer support providers and communication providers help Eduplore respond to support requests, send account notifications, send learning progress updates to parents and teachers, and send service messages, where the user has consented to receive them or where the message is needed to provide the service.

18.6. Analytics providers help Eduplore understand how users interact with the service, which video courses are most used, which three-dimensional laboratories are most explored, and where users encounter difficulties. Analytics providers that act as service providers provide reports to Eduplore only, and do not use the information for their own advertising purposes. Analytics providers that do not act solely as service providers are treated as third parties for the purposes of sale and sharing, and are covered by the opt-out right.

18.7. Advertising partners and advertising measurement providers, where used, help Eduplore show advertisements, measure whether an advertisement was viewed or clicked, and understand advertising effectiveness. The details of advertising partners are described in the AdChoices page. A user who opts out will not have personal information sold or shared with those partners for cross-context behavioural advertising.

19. Cookies, identifiers, and tracking technologies

19.1. Eduplore uses cookies and similar technologies on eduplore.in, and uses identifiers and software development kits in the Eduplore app, to operate the service, to remember user preferences, to keep a user signed in, to understand how the service is used, and, where applicable, to show advertisements and to measure advertising effectiveness. The details are described in the Cookie Policy and in the AdChoices page.

19.2. A cookie is a small text file stored on a user device by a website. A cookie may be a session cookie that is deleted when the browser is closed, or a persistent cookie that remains on the device for a period. Eduplore uses strictly necessary cookies that are needed for the website to function, preference cookies that remember language and display choices, and analytics cookies that help Eduplore understand usage.

19.3. An advertising identifier is an identifier provided by a device operating system, for example the advertising identifier on an Android device, that can be used to show advertisements and to measure advertising. A user can reset the advertising identifier or limit advertising tracking in the device settings, as described in the AdChoices page.

19.4. A software development kit, known as an SDK, is a set of tools provided by a third party that is included in the Eduplore app to provide a feature, such as analytics or advertising. An SDK may collect device information, usage information, and advertising identifiers, in accordance with its own privacy policy and with the Eduplore Privacy Policy.

19.5. An opt-out request under this page will stop the sale or sharing of personal information collected through cookies, identifiers, and SDKs for advertising purposes. It does not automatically delete cookies already stored on a device, and does not automatically reset an advertising identifier. A user who wishes to delete cookies should use the browser settings, and a user who wishes to reset an advertising identifier should use the device settings, as described in the AdChoices page.

19.6. Where Eduplore uses a consent management tool on eduplore.in, a user can manage cookie preferences through that tool, and can change the preferences at any time. The consent management tool will record the user choices and will apply them to future visits.

20. What happens after you opt out

20.1. After Eduplore verifies and applies an opt-out request, Eduplore will stop selling and sharing the personal information of the user who submitted the request, for the purposes covered by this page, promptly and within the time limit required by law.

20.2. Eduplore will notify the third parties to whom personal information was sold or shared in the preceding period, where Eduplore is required to do so by law, and will direct those third parties to stop selling or sharing the information, where applicable. Eduplore cannot control what a third party does after it receives personal information, and the third party is responsible for complying with its own legal obligations.

20.3. An opt-out does not delete personal information that Eduplore has already collected, and does not stop Eduplore from using personal information to provide the learning service. A user who wishes to delete personal information should submit a deletion request under the Privacy Policy.

20.4. An opt-out does not stop Eduplore from showing advertisements that are not based on personal information, for example contextual advertisements that are based on the content of a page or lesson rather than on the user profile. A user who opts out may still see advertisements, but those advertisements will not be targeted based on personal information sold or shared for cross-context behavioural advertising.

20.5. An opt-out will remain in effect until the user withdraws it by opting back in through a clear affirmative action, or until Eduplore is required by law to change the opt-out status. Eduplore will not ask a user to renew an opt-out request at regular intervals, and will not treat a general use of the service as a withdrawal of the opt-out.

20.6. If a user creates a new account, uses a new device, or uses a new browser, the opt-out may not automatically apply to the new account, device, or browser. The user should submit a new opt-out request for the new account, device, or browser, or contact support to link the accounts, so that the opt-out can be applied correctly.

21. Retention and security

21.1. Eduplore retains personal information only for as long as it is needed for the purposes for which it was collected, including to provide the learning service, to manage accounts and subscriptions, to provide customer support, to comply with legal obligations, and to resolve disputes. The retention periods are described in the Privacy Policy.

21.2. Learning records, including video course progress, three-dimensional laboratory usage, quiz scores, and progress analytics, are retained for as long as the student account is active, and for a period after the account is closed, where retention is needed for accounting, for school records, or for legal compliance. After the retention period, learning records are deleted or de-identified in accordance with the retention policy.

21.3. Opt-out records, including the date of the request, the date the opt-out was applied, and the verification method, are retained for the period required by law and by the retention policy, for compliance purposes. Opt-out records are not used for advertising.

21.4. Eduplore maintains reasonable security practices and procedures to protect personal information from unauthorised access, disclosure, alteration, and destruction. Those practices include access controls that limit access to personal information to staff who need it to perform their duties, encryption in transit and at rest where appropriate, secure storage of account credentials, regular review of access permissions, and training for staff who handle personal information.

22. Schools and institutional accounts

22.1. A school that uses Eduplore may have an institutional agreement with Eduplore that sets out the responsibilities of the school and of Eduplore for student personal information. That agreement applies in addition to this page and to the Privacy Policy.

22.2. Where a school is the Data Fiduciary under the DPDP Act 2023 and Eduplore is the Data Processor, the school is responsible for obtaining parental consent, for handling Data Principal rights, and for informing parents about the processing. Eduplore will assist the school as required by the agreement and by law.

22.3. Where Eduplore is the Data Fiduciary and the school provides student information to Eduplore, Eduplore is responsible for protecting that information, for honouring opt-out requests, and for responding to Data Principal rights, in accordance with this page and the Privacy Policy.

22.4. A school administrator may submit an opt-out request on behalf of the school students, as described in Section 11. The school should provide a list of the students covered by the request and evidence of its authority. Eduplore will apply the opt-out to the student accounts identified in the request.

23. Changes to this page

23.1. Eduplore may update this page from time to time to reflect changes in the law, changes in Eduplore practices, or changes in the services offered. Eduplore will publish the updated page on eduplore.in and in the Eduplore app, and will record the last updated date in the Contact Information section.

23.2. Where a change is material, for example where Eduplore begins to sell or share a new category of personal information, or where Eduplore adds a new category of third party recipient, Eduplore will provide notice of the change before it takes effect, through the website, the app, or by email where an email address is available.

23.3. A user who has opted out will remain opted out after a change, unless the user withdraws the opt-out. A change to this page does not withdraw an existing opt-out.

24. Complaints and regulatory contacts

24.1. A user who has a concern about Eduplore privacy practices should first contact Eduplore support using the contact details in Section 25. Eduplore will acknowledge the concern and will work to resolve it promptly.

24.3. A user in India who believes that Eduplore has not complied with the DPDP Act 2023 may contact the Data Protection Board of India, in accordance with the DPDP Act 2023 and the rules made under that Act. A user should first raise the concern with the Eduplore Grievance Officer, as described in Section 13.

24.4. A consumer in India who has a complaint under the Consumer Protection Act 2019 may raise the complaint through the consumer dispute redressal mechanisms under that Act, as described in Section 15.
